Biographie (Bio in English under<\/em> the French biography<\/span>)<\/strong><\/p>\n

Apr\u00e8s des \u00e9tudes linguistiques \u00e0 l\u2019Universit\u00e9 de Lille III, j\u2019ai successivement travaill\u00e9 dans le domaine de la Communication pour promouvoir l\u2019image de divers employeurs prestigieux notamment l\u2019Ambassade des \u00c9tats-Unis \u00e0 Paris, des investisseurs moyen-orientaux, le club de football RC Lens et la banque de gestion de fortune UBS France \u00e0 Paris. Sur le plan associatif, j’ai \u00e9tudi\u00e9 avec plusieurs experts les moyens d’optimiser les performances des entreprises et les renforcer structurellement. Ces experts aujourd’hui reconnaissent mes m\u00e9thodes d’empowerment par l’\u00e9thique. Je fonctionne avec eux en synergie pour ce qui touche aux questions de s\u00e9curit\u00e9 en entreprise.<\/p>\n

L\u2019affaire UBS :<\/strong> mon \u00e9thique a fait tr\u00e9bucher un G\u00e9ant<\/p>\n

Chez UBS France, j’\u00e9tais charg\u00e9e de d\u00e9velopper des partenariats avec des enseignes prestigieuses et d\u2019organiser des \u00e9v\u00e9nements pour fid\u00e9liser les clients fortun\u00e9s de la banque et attirer de nouveaux clients. En juin 2008, ma sup\u00e9rieure hi\u00e9rarchique m\u2019a ordonn\u00e9 de d\u00e9truire le contenu de mes fichiers informatiques suite \u00e0 une perquisition dans le bureau parisien du Directeur G\u00e9n\u00e9ral. En conscience et au regard du droit, cela m’\u00e9tait impossible. L’avenir m’a donn\u00e9 raison. Ces fichiers contenaient les coordonn\u00e9es des clients et des prospects de la banque ainsi que le nom de leurs charg\u00e9s d\u2019affaires (banquiers) en France, en Suisse ou dans d\u2019autres pays. Sans ordre \u00e9crit de sa part, je n’ai pas ex\u00e9cut\u00e9 l’ordre verbal demand\u00e9. S’en est suivi un v\u00e9ritable bras de fer que j’ai gagn\u00e9 : j’ai r\u00e9sist\u00e9 au harc\u00e8lement, la mise au placard et la discrimination, ce qui m’a m\u00eame permis de d\u00e9terminer avec pr\u00e9cision quels moyens \u00e9taient utilis\u00e9s afin d’affaiblir un employ\u00e9. (Aujourd’hui je donne aux personnes ayant \u00e0 subir ce genre de techniques ill\u00e9gales les moyens de vaincre ces pressions et d’en confondre en justice les auteurs… J’ai gagn\u00e9 tous mes proc\u00e8s. Mes m\u00e9thodes fonctionnent). \u00c9lue du personnel, comme le droit l’ordonne, j\u2019ai communiqu\u00e9 aupr\u00e8s des collaborateurs de la banque des informations discut\u00e9es pendant les r\u00e9unions avec la Direction. A ce titre en 2010, UBS France a port\u00e9 plainte contre moi pour diffamation ; la banque perdra ce proc\u00e8s et apr\u00e8s des mois de pression et de complications professionnelles, je serai finalement licenci\u00e9e en f\u00e9vrier 2012. Cependant, on ne peut pas diffamer un employ\u00e9 et d\u00e9poser plainte pour diffamation contre cet employ\u00e9 en esp\u00e9rant gagner. Mon accusateur a perdu au tribunal. Dans mes m\u00e9thodes, j’explique comment retourner la force de son adversaire contre lui-m\u00eame.<\/p>\n

Consid\u00e9r\u00e9e comme lanceuse d\u2019alerte – par la presse – d\u00e8s 2008 apr\u00e8s avoir d\u00e9nonc\u00e9 les activit\u00e9s et op\u00e9rations ill\u00e9gales de collaboration active de mon employeur avec la direction et les banquiers de UBS AG \u00e0 la fois en interne aux diff\u00e9rentes hi\u00e9rarchies de la banque mais \u00e9galement \u00e0 l\u2019Inspection du Travail, j’ai \u00e9t\u00e9 re\u00e7ue par la BRDP (Brigade de R\u00e9pression de la D\u00e9linquance contre les Personnes) en f\u00e9vrier 2011 et en mars 2015. Les pressions psychologiques de mon ex-employeur m’avaient certes affaiblie, mais je restais encore une personne digne de confiance, mentalement forte et capable de remplir des missions (*). La meilleure preuve de cette capacit\u00e9 c’est que j’ai \u00e9t\u00e9 recrut\u00e9e par le SNDJ (Douanes Judiciaires) au printemps 2011 : certes, j\u2019ai \u00e9t\u00e9 contrainte par le droit d’informer ces fonctionnaires asserment\u00e9s des pratiques et processus internes de la banque et de leur remettre, sur ordre, des documents confidentiels appartenant \u00e0 mon employeur de l’\u00e9poque jusqu’\u00e0 l’\u00e9t\u00e9 2012, mais c’est la force psychologique que j’ai d\u00e9velopp\u00e9e pendant mes ann\u00e9es de lutte qui m’a permis de ramener des milliards \u00e0 l’Etat fran\u00e7ais.<\/p>\n

J\u2019ai par ailleurs \u00e9t\u00e9 re\u00e7ue et entendue au S\u00e9nat par M. Eric Bocquet, rapporteur de la Commission \u00c9vasion Fiscale en 2012 et par le d\u00e9put\u00e9 M. Yann Galut en juillet 2013. J’apparais dans les rapports de la commission d\u2019enqu\u00eate s\u00e9natoriale du 17 juillet 2012 et du 17 octobre 2013.<\/p>\n

Reconnue pour mes capacit\u00e9s \u00e0 combattre pour l’\u00e9thique de fa\u00e7on tr\u00e8s op\u00e9rationnelle \u00e0 l’international, j\u2019ai rencontr\u00e9 \u00e0 plusieurs reprises des enqu\u00eateurs belges en 2014 et 2015 concernant les pratiques et processus internes d\u2019UBS en Belgique. Le 17 juin 2015, j\u2019ai \u00e9t\u00e9 re\u00e7ue \u00e0 l’ambassade d\u2019Argentine \u00e0 Paris sur invitation de M. Ricardo Echegaray, directeur de l\u2019AFIP pour \u00eatre entendue par les membres de la commission bicam\u00e9rale du Congr\u00e8s argentin qui enqu\u00eataient sur la fraude fiscale.<\/p>\n

(*) Un ex-agent de la DGSE a d\u00e9clar\u00e9 \u00e0 ma propre m\u00e8re que j’avais beaucoup de courage et que j’\u00e9tais digne de confiance !<\/p>\n

Parcours en Justice<\/strong><\/p>\n

Mieux vaut combattre pour l’\u00e9thique que contre l\u2019\u00e9thique ! Apr\u00e8s avoir gagn\u00e9 le proc\u00e8s de 2010 en diffamation, le tribunal des Prudhommes a reconnu en f\u00e9vrier 2015 le harc\u00e8lement souffert au sein de la banque.<\/p>\n

En f\u00e9vrier 2017, je me suis rendue au TGI de Paris, la banque UBS estimant que certains paragraphes de mon premier ouvrage \u201cLa femme qui en savait vraiment trop\u201d \u00e9taient diffamants. Un sursis \u00e0 statuer a \u00e9t\u00e9 d\u00e9cid\u00e9, ce qui signifie que le jugement devait avoir lieu apr\u00e8s le proc\u00e8s d\u2019UBS au Tribunal Correctionnel. Mais en juin 2021, UBS a subitement enlev\u00e9 sa plainte apr\u00e8s que le proc\u00e8s en appel concernant l’\u00e9vasion fiscale ait eu lieu (cf paragraphe ci-dessous).<\/p>\n

Le proc\u00e8s UBS au Tribunal Correctionnel de Paris s\u2019est tenu \u00e0 l\u2019automne 2018 : la banque a \u00e9t\u00e9 condamn\u00e9e d\u00e9but 2019 \u00e0 une amende record de 4,5 milliards d\u2019Euros. Le proc\u00e8s en appel s’est tenu en mars 2021. Le jugement rendu public en d\u00e9cembre 2021 a confirm\u00e9 la condamnation des dirigeants et d’UBS France. Chaque partie a d\u00e9clar\u00e9 ne pas se pourvoir en Cassation, leurs jugements sont donc d\u00e9finitifs. Seule la banque UBS AG, condamn\u00e9e en appel elle aussi, a d\u00e9cid\u00e9 de faire appel de ce jugement. En novembre 2023, l’arr\u00eat rendu par la chambre criminelle de la Cour de Cassation a confirm\u00e9 les condamnations et renvoy\u00e9 vers la Cour d’Appel pour r\u00e9-examiner les montants de l’amende et des dommages et int\u00e9r\u00eats pour l’Etat.<\/p>\n

J\u2019ai par ailleurs attaqu\u00e9 l\u2019Etat au Tribunal Administratif ; la justice m’a reconnue \u201ccollaboratrice du service public\u201d en novembre 2018. Depuis, le Minist\u00e8re des Finances a refus\u00e9 de r\u00e9tribuer mon travail aupr\u00e8s de ses \u00e9quipes mais un nouveau jugement du Tribunal Administratif de juillet 2022 a jug\u00e9 que l’Etat devait revoir sa position quant \u00e0 son refus de m’indemniser. Bercy a d\u00e9cid\u00e9 de faire appel de cette d\u00e9cision de justice. Contre toute attente, la Cour d’Appel Administrative en a jug\u00e9 tout autrement, donnant raison \u00e0 Bercy fin septembre 2023 de ne pas m’indemniser, ce qu’a confirm\u00e9 le Conseil d’Etat en f\u00e9vrier 2025.<\/p>\n

Enfin, j’ai officiellement \u00e9t\u00e9 reconnue avec le statut de \u00ab lanceuse d\u2019alerte \u00bb au sens de la loi SAPIN II par le D\u00e9fenseur des Droits dans un avis du 28 septembre 2022. A notre connaissance, c\u2019est la premi\u00e8re fois que le D\u00e9fenseur des Droits d\u00e9livre un avis sur la qualit\u00e9 de lanceur d\u2019alerte depuis que loi Waserman (loi du 21 mars 2022) permet cette possibilit\u00e9 (avis n\u00b0 LA 2022-01).\u00a0<\/p>\n

Nominations et D\u00e9corations<\/strong><\/p>\n

En janvier 2015, j\u2019ai re\u00e7u le prix Ethique de l’association Anticor lors de la soir\u00e9e \u00ab \u00c9thique contre casseroles \u00bb pour la publication de mon ouvrage \u201cLa femme qui en savait vraiment trop\u201d.<\/p>\n

Le 10 septembre 2015, j\u2019ai \u00e9t\u00e9 nomin\u00e9e pour le Prix Sakharov aux c\u00f4t\u00e9s de deux autres lanceurs d\u2019alerte, Edward Snowden et Antoine Deltour.<\/p>\n

En septembre 2019, j\u2019ai \u00e9t\u00e9 d\u00e9cor\u00e9e pour mon courage par le Lieutenant Colonel Lianos de l\u2019Association des Anciens Combattants de la L\u00e9gion Etrang\u00e8re.<\/p>\n

En d\u00e9cembre 2024, j’ai re\u00e7u le dipl\u00f4me et la m\u00e9daille d’argent avec Palme & Couronne (Vermeil) par la Ligue Universelle du Bien Public au Cercle National des Arm\u00e9es pour les actions que j’ai men\u00e9es contre la corruption depuis 2007.<\/p>\n

En 2018, 2019 et 2020, j’\u00e9tais membre du Jury du Prix Daphn\u00e9 Caruana, qui r\u00e9compense au Parlement Europ\u00e9en celles et ceux qui \u0153uvrent pour la v\u00e9rit\u00e9, \u00e0 savoir les \u2018Journalists, Whistleblowers and Defenders of the Right to Information\u2019 (journalistes, lanceurs d\u2019alerte et d\u00e9fenseurs du droit \u00e0 l\u2019information). A la demande de son auteur Xavier de Fontgalland, j’ai \u00e9crit la postface de son ouvrage ‘Des vies d\u00e9rob\u00e9es par une grande banque fran\u00e7aise’ (octobre 2023) li\u00e9e au lancement d’alerte.<\/p>\n

Adam Bouti, auteur de l’ouvrage ‘L’information est un sport de combat’ (janvier 2025) m’a demand\u00e9 d’\u00e9crire un chapitre d\u00e9di\u00e9 \u00e0 l’\u00e9thique du lancement d’alerte.<\/p>\n

Nouvelles perspectives<\/strong><\/p>\n

Depuis 2017, je donne des conf\u00e9rences en entreprise, dans des \u00e9coles et universit\u00e9s concernant les enjeux du lancement d\u2019alerte. J’interviens en tant que grand t\u00e9moin, en tant qu’expert, conseil, consultant aupr\u00e8s de Compliance Officers, cadres et collaborateurs d’entreprises, \u00e9tudiants fran\u00e7ais au sein de programmes allant de “Ethics & Sustainability” \u00e0 l’\u00e9thique du lancement d’alerte.<\/p>\n

Mon parcours de vie d\u00e9montre que mes m\u00e9thodes de lutte pour l’\u00e9thique sont \u00e9prouv\u00e9es. Les suivre auraient pu faire \u00e9conomiser 14 ann\u00e9es de proc\u00e9dures, de nombreux proc\u00e8s publics et beaucoup d’argent \u00e0 mon ex-employeur. Un agent du CSE est quelqu’un qui a int\u00e9r\u00eat \u00e0 d\u00e9fendre son entreprise. J’\u00e9tais un agent CSE, aguerrie dans la Communication de crise dans le domaine du football juste avant mon embauche dans cette banque internationale, j’ai juste fait mon travail en pr\u00e9venant mon ex-Direction. A ses d\u00e9triments, ceux de ses collaborateurs et de ses clients, elle a choisi la voie la plus condamnable…<\/p>\n

Avec des experts issus de diff\u00e9rents domaines, nous avons d\u00e9velopp\u00e9 le projet Renform’action<\/strong><\/em> \u00e0 destination des directions d’entreprise pour atteindre des objectifs d’\u00e9thique, d’int\u00e9grit\u00e9, de protection des int\u00e9r\u00eats des structures et d\u2019encouragement aux conversations complexes avec leurs collaborateurs, voire aux lancements d’alerte de ces derniers pour que l’alerte soit g\u00e9r\u00e9e en interne.<\/p>\n

J\u2019ai par ailleurs d\u00e9velopp\u00e9 des modules d’information pour sensibiliser les collaborateurs du secteur priv\u00e9 et les fonctionnaires des administrations aux enjeux li\u00e9s \u00e0 la n\u00e9cessit\u00e9 de l\u2019\u00e9thique du monde professionnel.<\/p>\n

Biography<\/strong><\/p>\n\n\n\n

After linguistic studies at the University of Lille III, I successively worked in the field of Communication to promote the image of various prestigious employers including the United States Embassy in Paris, Middle Eastern investors, the RC Lens football club and the wealth management bank UBS France in Paris. At the associative level, I have studied ways to optimise the performance of companies and strengthen them structurally with several experts. These experts today recognise my methods of ethical empowerment.<\/p>\n\n\n\n

The UBS story:<\/strong> my Ethics tripped a Giant<\/p>\n\n\n\n

At UBS France, I was in charge of developing partnerships with prestigious brands and organise events to retain the wealthy clients of the bank and attract new clients. In June 2008, my manager ordered me to delete the content of my computer files after a search had taken place in the office of the General Manager in Paris. As per my values and as per the French law, it was impossible for me to obey. The future proved that I was right. These files contained the coordinates of clients and prospects of the bank as well as the names of their bankers in France, Switzerland or in other countries. Without a written instruction from my manager, I did not execute the verbal order given. Followed a real standoff which I won: I resisted harassment, discrimination and being canned which has enabled me to accurately and precisely determine which means can be used in order to weaken an employee. Nowadays, I give the means to defeat these pressures and to take their authors to court to persons who have to suffer this kind of illegal techniques. I have won all my trials. My techniques work.<\/p>\n\n\n\n

As an elected staff representative, as required by law, I communicated the pieces of information discussed during the meetings with the top management to all the employees of the bank. As such, UBS France filed a complaint against me for defamation ; the bank lost this trial and after months of pressure and professional complications, I was made redundant in 2012. However one cannot defame an employee and file a complaint for defamation against this very employee and hope to win. My accuser lost at court. In my methods, I explain how to use the strength of the opponent against him. <\/p>\n\n\n\n

Considered as a whistleblower by the media as of 2008 after I had exposed the activities and illegal operations of my employer with UBS AG’s top management and bankers both internally to my different hierarchies at the bank but also to the Inspector of Work, I was listened to by the Brigade de R\u00e9pression de la D\u00e9linquance contre les Personnes in February 2011 and in March 2015. Even if the psychological pressures I had suffered from my former employer had weakened me, I was still a trusted person who is mentally strong and able to fulfill missions (*). <\/p>\n\n\n\n

How better prove my abilities but the fact that I was recruited by the French Judicial Customs (SNDJ) during the spring of year 2011: Even if I was indeed constraint by the law to inform sworn officers about the practices and internal processes of the bank and to submit on order confidential documents belonging to my employer until the summer of 2012, the psychological strength developed during my years of fight have made the difference and enabled to bring billions of Euros to the French state’s coffers.<\/p>\n\n\n\n

I have also been listened to at the Senate in 2012 by Mr. Eric Bocquet, rapporteur for the Commission of Inquiry on Tax Evasion and by Mr. Yann Galut, member of the Assemblee Nationale in July 2013. My name appears in the reports of the commission of the Senate Commission of Inquiry dated July 17th, 2012 and October 17th, 2013.<\/p>\n\n\n\n

Recognised abroad for my abilities to fight for Ethics in a very operational way, I have met several Belgian investigators in 2014 and 2015 regarding the practices and internal processes of UBS in Belgium. On June 17th, 2015, I was the guest of the Embassy of Argentina in Paris at the invitation of Mr. Ricardo Etchegaray, director of the AFIP in order to be listened to by the members of the bicameral commission of the Argentinian Congress who were investigating tax evasion.<\/p>\n\n\n\n

(*) A former officer of the French external intelligence agency (DGSE) has told my mother that I am a very courageous woman and that I am trustworthy! <\/p>\n\n\n\n

My Journey with the French Justice<\/strong><\/p>\n\n\n\n

One would rather fight for ethics rather than against ethics! After winning the defamation trial in 2010, the Tribunal des Prudhommes (French labor court) recognized in 2015 the harassment I had suffered within the bank.<\/p>\n\n\n\n

In February 2017, I had an audition for a new trial at the TGI de Paris (Paris High Court), the bank UBS considering that several paragraphs of my first book \u201cLa femme qui en savait vraiment trop\u201d (The woman who knew far too much) were defamatory. The Court has stayed proceedings pending a decision of the trial of the bank at the Tribunal Correctionnel (criminal court). However UBS removed its complaint in June 2021, after the appeal trial regarding the tax evasion file took place (see paragraph below).<\/p>\n\n\n\n

The UBS trial at the Tribunal Correctionnel de Paris (criminal court) took place during the fall of year 2018: the bank was sentenced a record \u20ac4.5 billion fine at the beginning of 2019. The appeal trial took place in March 2021 and the judgement made public in December 2021 confirmed their sentence; with a lower fine down to \u20ac1.8 billion. UBS France and the managers have declared not to appeal the decision however UBS AG (Switzerland) appealed in the Cour de Cassation which decided to confirm the motivation of the appeal judgment and to send the case back to the Cour d’Appel as far as the fine was concerned. <\/p>\n\n\n\n

I sued the French State at the Tribunal Administratif (administrative court) where the justice recognised that I was a \u201ccollaborator of the public service” in November 2018. Since, the Minister of Finances has been refusing to pay the work I did with its teams. Another judgment from the Tribunal Administratif dated July 2022 ordered the French Administration to review their position as far as their refusal to pay my information. The Ministry of Finances has decided to appeal this justice decision and was proved right by both the Administrative Appeal Court in September 2023 and the Conseil d’Etat in February 2025.<\/p>\n\n\n\n

Hence, in September 2022, I was officially recognized with a status of Whistleblower by the Defender of Rights, which is the first decision in this respect since the Waserman law passed in March 2022 in France.<\/p>\n\n\n\n

Nominations and Decorations<\/strong><\/p>\n\n\n\n

In January 2015, I received the Ethics prize of the Anticor association during their “Ethics vs. casseroles (pans)” evening for the publication of my book \u201cLa femme qui en savait vraiment trop\u201d.<\/p>\n\n\n\n

On September 10th, 2015, I was nominated for the Sakharov Prize with two other whistleblowers, Edward Snowden and Antoine Deltour.<\/p>\n\n\n\n

In September 2019, I was decorated for my courage by Lieutenant Colonel Lianos on behalf of the Association des Anciens Combattants de la L\u00e9gion Etrang\u00e8re.<\/p>\n\n\n\n

I received the diploma and the Silver medal with palm and crown (Vermeil) of the Universal League of the Common Good at the Cercle National des Armees in Paris on December 6th, 2024 for the work provided as far as fighting fraud and corruption since 2017.<\/p>\n\n\n\n

Jury<\/strong><\/p>\n\n\n\n

I was a member of the Jury of the Daphn\u00e9 Caruana Prize in 2018, 2019 and 2020. At the European Parliament, this prize awards the ones who act for the truth, namely the \u2018Journalists, Whistleblowers and Defenders of the Right to Information\u2019. In 2019, we decided to grant the awards to Julian Assange, Yasmine Motarjemi and Rui Pinto.<\/p>\n\n\n\n

New perspectives<\/strong><\/p>\n\n\n\n

Since 2017, I have given conferences in companies, schools and universities regarding the stakes of whistleblowing. For four years, I have also been a Key Witness during the Compliance Officer Diploma at the Universit\u00e9 Paris II Panth\u00e9on-Assas (CFP) and have given talks to international students at HEC about the ethics of whistleblowing during their “Ethics and Sustainability” class. <\/p>\n\n\n\n

My life journey proves that my fighting methods in favour of ethics work. Following them would have made my former employer save \u20ac4,5 billion. An ethical employee\/executive is somebody who is interested in defending the company (s)he works for. I was an ethical executive, an expert in communication crisis in the football field before being hired by this international bank. I only did my work while warning my former top management. To its detriment, to the ones of its employees and its clients, it chose the most reprehensible way…<\/p>\n\n\n\n

With experts from different business fields, we have developed the Renform’action<\/strong><\/em> project (translation of three French words: Strengthen – Train – Take Action) aimed at company managements in order to reach goals linked to ethics, integrity, protection of the interests of the structures and also encourage difficult conversations with the employees, even blow the whistle in order for the alert to be managed internally.<\/p>\n\n\n\n

I have also developed information modules (videos) to sensitive the private and public sectors employees \/ executives about the need of ethics in the professional world.<\/p>\n\n\n\n
